Ebtech 1 Year Limited Warranty

Warranty: EBTECH warrants to the original purchaser that EBTECH standard products will be free of manufacturing defects for a period of one (1) year from the date of manufacture.

The EBTECH products are only warranted when properly installed in accordance with published installation instructions, all applicable building codes and industry standards in effect at time of installation and in a properly constructed and designed environment.(ii) These warranties are only applicable for United States customers and for U.S. usage.

Warranty Claims:

Claims under the Warranties will only be honored if:  (1) EBTECH is notified in writing within fifteen (15) days of discovery of the condition covered by the Warranty, and (2) EBTECH is given a reasonable opportunity to evaluate the product prior to any alteration, change or repair.

Exclusive Remedies

If manufacturing defects are found, EBTECH will, at its sole discretion, repair, or replace the defective products, or refund the purchase price paid by the original purchaser.  If EBTECH elects to repair or replace the defective products, it may furnish labor and materials necessary to repair or replace the defective products.   EBTECH shall not be responsible for any other labor or materials.

Exclusions from the Warranty:

This Limited Warranty does not cover third party manufactured components and all such third party components are sold by EBTECH “AS IS.” EBTECH is not responsible for warranties, if any, given by any third party manufacturers for such components, and EBTECH does not make any warranties, express or implied, with regard to such third party components, including any implied warranty of merchantability or fitness for a particular purpose.

This Limited Warranty does not cover damage, claims, or defects in the products including delaminating, warping, cracking, splitting or failure due to: misuse or improper handling, secondary treatments, storage, transfer, installation or maintenance; alterations to the structure after the original installation; removal or replacement of any of the original materials; abnormal exposure to moisture, excess heat or other similar conditions;  physical forces such as fire, floods, natural disasters or other acts of God;  corrosive elements;  damages caused by persons other than EBTECH personnel;  termites or other wood destroying organisms, including mold and mildew;  or use of the components other than as part of the original EBTECH structure.   Manufactured housing applications that are built under a federal building code administered by the U.S. Department of Housing and Urban Development (HUD) are also expressly excluded from these warranties.

Exclusion of other warranties, express or implied: Other than the express warranties granted in this document, the products are sold “as is” and “with all faults.”  THE WARRANTIES AND REMEDIES NOTED ABOVE APPLY ONLY TO THE ORIGINAL PURCHASER   AND ARE THEIR SOLE AND EXCLUSIVE REMEDIES EXCEPT AS OTHERWISE REQUIRED BY LAW, AND ARE IN LIEU OF AND EXCLUDE ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  EBTECH WILL NOT BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, AND CONSEQUENTIAL OR PUNITIVE DAMAGES INCLUDING AND NOT LIMITED TO LOST PROFITS, LOSS OF USE OR ANY OTHER TYPE OF DAMAGE REGARDLESS OF THE THEORY UNDER WHICH SUCH DAMAGES ARE SOUGHT.(iii)

Customer Support: If you experience problems with your EBTECH Industrial products call us at 1-724-628-6100 before physically correcting the problem and an EBTECH representative will help you evaluate the problem.  You must promptly contact an EBTECH representative and provide validation of purchase date (invoice or similar document from the original purchaser) to correct any problem.

(i.) Limitations and restrictions apply.

(ii.) Proper installation shall be deemed to mean the most restrictive of the requirements specified by EBTECH Industrial, local building code provisions, the model building code adopted by the local jurisdiction, the government agency having jurisdiction, or the engineer or architect of record.

(iii.) These exclusions may not apply where such warranties arise under applicable consumer product warranty laws and cannot lawfully be disclaimed.  Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above exclusions may not apply to you.
